Handling Illegal Questions
By law, an interviewer can only ask questions that relate to your ability
to perform the essential functions of the job.
If asked an illegal question:
- You can answer, however, you may be giving
information that isn't related to the job and may influence the interviewer
- You can refuse, unfortunately you run the
risk of appearing uncooperative or confrontational
- You can examine the question and respond
to the intent
Example:
If asked:
"I see you are in a wheelchair. What happened to you?"
A good response would be:
"Although I am disabled, my wheelchair does not prevent me in any
way in carrying out the requirements for the position. For example I am
able to
."
Note:
Do you need an accommodation to perform the job? It is important to know
that an employer can not ask this question until a job offer has been made.
